Tenure Initial period of Three (03) Years or until further orders, whichever is earlier. Performance will be reviewed annually. Empanelment may be extended based on satisfactory performance. ESIC reserves the right to terminate empanelment at any time with 15 days’ notice.

Fee Structure (Consolidated Professional Fees)

2 EI Courts, Magistrate Courts and District Consumer Forum ₹5,000/-
  • 50% of the fee may be paid after completion of pleadings/written statement (if requested by the advocate).
  • Remaining 50% shall be paid after arguments, finalization of the case, and submission of certified copy of judgment along with legal opinion (if judgment is adverse to ESIC fully or partially).
  • Miscellaneous expenditure including Court Fees shall be reimbursed on actual basis upon submission of bills/vouchers.

Eligibility Criteria

  • Minimum qualification of LLB from a recognized University.
  • Minimum 5 years’ standing practice at the Bar.
  • Experience in handling Labour Law related cases.
  • Must be well versed with the ESI Act and other related Acts and Codes.
  • Should not be handling any case against the Corporation at present.
  • Must not take up any case against ESIC during the empanelment period.

Age Limit

Age at the time of empanelment should preferably be below 65 years.

Application Process

  1. Download the prescribed application form (Annexure-A & B) from the official website.
  2. Fill the application form in the prescribed format.
  3. Attach all required supporting documents.
  4. Place the application in a sealed envelope.
  5. Superscribe the envelope with: “Application for Empanelment of Advocate for High Court, EI Courts, Magistrate Courts and District Consumer Forum in the Goa jurisdiction.”
  6. Submit the application to the Regional Director (I/c), ESIC, Panchdeep Bhavan, EDC Plot No-23, Patto, Panaji, Goa – 403001.

  • Matriculation Certificate (Proof of Age)
  • Certificate of Registration with Bar Council
  • Identity Card issued by Bar Association/Bar Council
  • Certificates in support of Educational Qualification
  • Full details of experience in the field of Labour Laws
  • Undertaking stating that all furnished information is correct

Selection Process

  • Applications will be considered strictly on merit.
  • Length of practice and specialization relevant to ESIC matters will be given priority.
  • Empanelment decision will be communicated in writing.
  • Empanelment will be complete only after receipt of acceptance letter from the Advocate.

General Conditions & Responsibilities

  • Advocate shall accept work assigned and shall not refuse cases without reasonable cause.
  • Advocate shall not contest any case against ESIC while empanelled.
  • Maintain absolute secrecy and confidentiality regarding ESIC cases.
  • Represent ESIC before High Court, EI Court, Magistrate Court, Labour Court, State Consumer Forum, etc.
  • Prepare Written Statements, Appeal Memo, Applications and provide legal opinions.
  • Ensure no ex-parte orders are passed against ESIC.
  • Collect and produce certified copies of judgments within stipulated time along with legal opinion.
  • Provide opinion within 5 working days in case of adverse order.
  • No traveling expenses or miscellaneous allowance will be paid.
  • Empanelment does not guarantee appointment or engagement in specific cases.

Disqualification / Cancellation Grounds

  • Providing false information.
  • Failing to attend hearings without sufficient reason.
  • Professional misconduct or contempt of court.
  • Conviction in any offence or disbarment by Bar Council.
  • Sharing confidential information damaging ESIC interests.
  • Frequent adjournments without valid reason.
